Restream, Inc. (referred to herein as “Restream”, “we”, “our”, or “us”) recognizes the importance of protecting personal information we may collect from customers, website visitors, and any other individual (“you” or “your”). This Privacy Policy applies to data collected by Restream and applies when you visit our website where this Privacy Policy is posted (https://restream.io/) (the “Site”) and through our interactions with individuals by email, telephone, or other means.

Our Privacy Policy explains: (1) what information we collect; (2) why we collect it; (3) how we use that information; (4) how we may share it; and (5) the rights you may have.

Restream is the data controller of the personal information of United States (“U.S.”), United Kingdom (“UK”), and European Economic Area (“EEA”) residents accessing and using the Site and/or our services. In specific instances where we receive your personal information from third parties, or where we are instructed to collect and process your personal information for purposes not defined by Restream, we may act also as a data processor, following the directives of such third parties and applicable laws.

The Information Restream Collects

We collect information, including personal information, to provide better services to you. We use the term “personal information” to refer to any information that identifies or can be used to identify you. Common examples of personal information include: name, demographic data, email address, digital identifier, such as your IP address, information about your device, and certain metadata. We collect personal information from the following sources: directly from you, automatically when you use our Site or services, and through our partners and other third parties. The personal information which we collect includes, but is not limited to, the following circumstances and data elements:

Generally.

  • If you express an interest in obtaining additional information about our products and services, register for a Restream service, submit testimonials, request customer support, request more information, use our digital chatbot feature or similar features on the Site, or upload or download content, files, or products to or from the Site or our services, we may require that you provide to us your contact information, such as your name, phone number, and email address;
  • If you report a problem or have a question about our Site, you may provide us with contact information, such as a phone number or email address;
  • If you communicate with our team (such as via email or phone), we may collect information about you and any other information that you provide;
  • Payments for Restream products and services are processed by third-party payment providers, including Stripe. Restream does not directly collect or store your full payment card information. We may receive limited billing and transaction information from these providers, such as your billing name and address, payment status, transaction identifiers, and limited details about the payment method used;
  • If you request or download marketing materials from us, such as through our Media Kit on the Site, we may collect your contact information, such as your name, phone number, and email address;
  • When you create, edit, or share short-form video content using our Clips feature, we collect and process the video, audio, and metadata associated with your Clips. Clips data may include source recordings, edits, captions, and sharing preferences.
  • When you access Restream services or open one of our HTML emails, we may automatically collect certain information from you by using cookies and other types of tracking tools, such as your IP address, unique user ID, device type, device identifiers, browser types and language, referring and exit pages, platform type, version of software installed, system type, the content and pages that you access on the Site, the number of clicks, the amount of time spent on pages, the dates and times that you visit the Site, and other similar information;
  • We may obtain information, including personal information, from third parties and sources other than the Restream, such as advertisers. We also may obtain information, including personal information, from third parties such as social media or social network platforms which you have explicitly connected to Restream services (e.g., information from YouTube using YouTube API Services, Twitch, Youtube, Smashcast, Mixer, or any other platform the Restream services connects with). When you access our Site or services, we may collect information about your use of the content you choose to broadcast through our services. If we combine or associate information from other sources with personal information that we collect from you directly, we will treat the combined information as personal information in accordance with this Privacy Policy;
  • If you access your Restream account through a third-party connection or account (e.g., Google, Facebook, Apple, or LinkedIn), Restream receives and stores information about your connected account for authentication purposes. This information may include your email address, username, user ID associated with your account (e.g., your Facebook UID), profile picture, and any other basic account information you’ve made publicly available. You should always review and adjust your privacy settings on third-party services you have permitted to access your account. You may also revoke the access to individual services by visiting a corresponding third-party service page. If you unlink your third-party account, we will no longer receive information collected about you in connection with that service, but you’ll be unable to access your Restream account through that third-party service;
  • Depending on the features you use and the third-party platforms you connect, we also collect: account and authentication information (such as user ID, workspace or team identifiers, role, permissions, and authorization status); connected platform and destination information (such as connected accounts, destination and channel identifiers, and the stream keys or tokens needed to operate the Service); broadcast and scheduling information (such as titles, descriptions, thumbnails, privacy settings, scheduled times, status, recordings, uploads, and related metadata); studio, chat, and engagement information (such as comments, chat messages, reactions, and participant or guest information) where those features are used; and the requests or instructions you or an application acting on your behalf submit, together with the results we return in response. The specific information processed depends on the features you use, the permissions you grant, and the platforms you connect; or
  • If you provide us with any personal information relating to other individuals, such as through our Referral Program, you represent that you have the authority to do so and acknowledge that it will be used in accordance with this Privacy Policy; if you believe that your personal information has been provided to us improperly, or to otherwise exercise your rights relating to your personal information, please contact us by using the information set out in the “Contact Us” section below.

Online Account. When you register for or create an account online, we collect the information you provide, such as your first and last name, email address, and password. We use this information to create your account, to provide, customize, and improve our product and services offerings to you, to market our products and services, and to communicate with you.

Event Registration. When you register for or attend an event, webinar, presentation, or similar program offered through the Restream platform, we may collect personal information such as your name, email address, phone number, and other registration or attendance-related information. We may share this information with the event organizer, host, sponsor, or presenter so they can manage the event, communicate with attendees, measure engagement, and for their own business, marketing, and other purposes as described in their privacy policies.

AI Chatbot. When you use the artificial intelligence (“AI”) chatbot functionality on the Site, we collect the information that you input and the content of your communications. We also maintain a transcript of chats for quality assurance and analytics purposes. Please avoid providing any sensitive information in a chat.

Job Applicants. Job application information may be collected by us directly through the Site, in-person, over the phone, or by email, or job application information may be collected on our behalf by our contracted third-party administrator(s) for applicant tracking purposes and by background check providers.

Business Contacts. We may receive contact information (including your name, telephone number, and email address) and/or professional or business-related information (including your business address), through our interactions with you in a business-to-business capacity, such as when your business provides services to us, or when we work together on a project, or when we discuss business opportunities. We may contact you with information about our business dealings, news, and opportunities, and we may use your information in the normal course of our business operations.

Social Media. If you post information on our page on a social media platform, we may use the information to respond, to promote our business and services, and in the normal course of our business operations. We may collect your personal information, such as your social media username, and other personal characteristics that you have made publicly available on the social media website. Note that the third-party operators of social media websites also receive such information, and their use of your personal information is governed by their own privacy policies.

Automated Data Collection: Cookies & Similar Technologies. We and our partners use cookies, pixels, web beacons, server logs, and similar technologies when you visit our Site or interact with our emails and services. These technologies may collect information such as your IP address, browser and device characteristics, device or online identifiers, operating system, referring and exit pages, pages or content viewed, interactions with our Site or emails, and approximate location derived from your IP address. We use this information to operate and improve the Site, understand usage, measure performance, prevent malicious conduct, and support our marketing activities. We also use Google and Meta advertising technologies for measurement and retargeting, including to show ads to people who have previously visited or interacted with our Site or services. Restream does not sell personal information. Certain disclosures through advertising technologies may, however, constitute “sharing” or “targeted advertising” under applicable U.S. state privacy laws. Where required, you may opt out by emailing support@restream.io or through other privacy controls we provide. In some cases, our partners may process information collected by cookies and similar technologies that we permit them to use on the Site. We also use Google Analytics to collect and process certain Site usage data. You may be able to change your browser settings to block or delete cookies, although some Site functionality may be affected. Restream does not respond to Do Not Track (DNT) signals or similar signals unless required by applicable law.

The Way Restream Uses Information

If you submit personal information to us through our Site or services, we use your information to operate, maintain, improve, and provide our Site and the general and personalised features and functionality of our products and services. We also use your personal information in ways that are compatible with the business and commercial purposes for which it was collected or authorized by you, including for the following purposes:

  • To present, operate, or improve the Site and our products and services, including analysis of Site activity;
  • To inform you about the products and services available from Restream;
  • To authorize access to our Site and your account;
  • To personalize your experience to deliver content and products that most interest you;
  • To market other products and services to you;
  • To improve our customer service;
  • To respond to your questions, comments, and requests and to provide support to you;
  • To ask for ratings and reviews of our services;
  • To follow up with you (such as via email or voice inquiries);
  • To comply with all applicable legal requirements; and
  • To investigate possible fraud or other violations of our Site’s service terms or this Privacy Policy and/or attempts to harm you.

Unless you ask us not to, we may contact you via email in the future to tell you about changes to this Privacy Policy. However, we may use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major Restream service changes or for customer service purposes).

To facilitate our Site and services, we obtain and use the stream channel name and key from each platform you have connected to the services.

We may use your connected account’s information and applicable permission to perform actions such as, but not limited to: “connecting”, “subscribing”, “following”, or “liking” only to or on the official Restream accounts associated with your connected social media or social network platform.

Our Legal Basis for Collecting and Processing Personal Information.

Whenever we collect personal information from you, we may do so on the following legal bases:

  • Your consent to such collection and use;
  • Out of necessity for the performance of an agreement between us and you, such as your agreement to use our services or your request for services;
  • Our legitimate business interest, including but not limited to the following circumstances where collecting or using personal information is necessary:
  • To perform services requested by you;
  • Intra-organization transfers for administrative purposes;
  • Product development and enhancement, where the processing enables Restream to enhance, modify, personalize, or otherwise improve our services and communications for the benefit of our users and customers, and to better understand how people interact with our Site;
  • Communications and marketing, including processing data for direct marketing purposes, and to determine the effectiveness of our promotional campaigns and advertising;
  • Fraud detection and prevention;
  • Enhancement of our cybersecurity, including improving the security of our network and information systems; and
  • General business operations and diligence;

Provided that, in each circumstance, we will weigh the necessity of our processing for the purpose against your privacy and confidentiality interests, including considering your reasonable expectations, the impact of processing, and any safeguards which are or could be put in place. In all circumstances, we will limit such processing for our legitimate business interest to what is necessary for its purposes.

When Restream Discloses Information

We may disclose any of the categories of personal information listed above for our business and commercial purposes as described below.

Authorized Recipients. We may disclose your personal information to third parties that you authorize to access or receive such information through Restream’s services, including AI-powered assistants, MCP clients, integrations, and other third-party applications that you enable or authorize to act on your behalf. When you connect or authorize such an application, or use a feature that involves other users or third parties, we may receive instructions or requests from you or from the application you have authorized, and we may provide information — such as your account, broadcast, destination, scheduling, status, and related information — to that application, service, or user so the requested action can be completed or shown to you. Information shared in this way is then handled according to the settings, permissions, and terms of the application, service, or user you interact with, and Restream does not control how they use that information once it has been provided to them. You should review the privacy and security practices of any application or service before connecting it to your account.

Service Providers and Vendors. We may disclose personal information to service providers working on our behalf to provide website hosting, maintenance, security, analytics, customer support, product functionality, and other services; assist Restream in improving the Site and developing new features; support our AI-assisted technologies; and process payments. Payments are processed by third-party payment providers, including Stripe, and Restream does not directly collect or store full payment card information. When we disclose personal information to service providers for these purposes, we require them by contract to process the information only as necessary to provide the applicable services and to protect it appropriately. Partners and Marketing Providers. We use advertising and analytics technologies provided by partners such as Google and Meta to measure the effectiveness of our advertising and to show advertisements to people who have previously visited or interacted with our Site or services (often referred to as retargeting). These technologies may collect or receive online identifiers, device and browser information, IP address, and information about your interactions with our Site. Restream does not sell personal information. However, certain disclosures to advertising partners for retargeting may be considered “sharing” or “targeted advertising” under applicable U.S. state privacy laws. Where required by law, you may opt out of this activity using the privacy choices described in this Privacy Policy.

Legal and Similar Purposes. We may disclose your personal information for legal reasons. Restream may disclose personal information with companies, organizations or individuals outside of Restream if we believe in good faith that such disclosure is necessary to: (i) comply with US state and federal laws (such as U.S. Copyright law) or other applicable laws around the world (for example, in the country of your residence); (ii) respond to a court order, judicial or other government subpoena, or warrant in the manner legally required by the requesting entity; or (iii) enforce our Site’s service terms, including investigation of potential violations.

Restream also reserves the right to disclose personal information that we believe in good faith is appropriate or necessary to: (iv) take precautions against liability to Restream; (v) protect Restream from abusive, fraudulent, or unlawful uses; (vi) investigate and defend ourselves against third-party claims or allegations to protect the security or integrity of the services; or (vii) protect the rights, property, or personal safety of Restream, you, or others.

We will attempt to notify you about legal demands for your personal information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

Merger, Sale, or Other Asset Transfers. We may disclose your personal information in the event of a business transfer. If we establish a new related entity, are acquired by or merged with another organization, or if substantially all of our assets are transferred to another organization, personal information about our users is often a transferred business asset. In the event that Restream itself or substantially all of our assets are acquired, personal information about our users may be one of the transferred assets.

When You Choose Not to Provide Personal Information

You may, of course, refuse to submit personal information through Site and/or services. However, your provision of personal information is required in order to access our products and certain parts of our services. If you choose not to provide such personal information, you may not be able to access our products and use our services.

Our Retention of Your Personal Information

We retain your personal information for as long as your account remains active, or as otherwise necessary to provide you the Site and our services. We do not currently delete personal information on a fixed schedule. If you would like your personal information deleted, you may submit a request using the contact information in the “Contact Us” section below; we generally aim to complete deletion requests within 30 days, though the time required may vary depending on the nature of the request and applicable law. We may retain certain information beyond that timeframe where necessary to comply with a legal obligation, resolve a dispute, enforce our agreements, or for other legitimate business purposes, such as applicable statutes of limitation.

If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of such data.

Personal information processed on our behalf by service providers and AI-assisted vendors described in “Service Providers and Vendors” above may be subject to those providers’ own retention and deletion practices.

Use of Artificial Intelligence

We use AI in the form of a digital chat-bot tool available to website visitors to answer your questions and to enable you to search for products and content and navigate the Site. With regard to the contents of your request (through a chat-bot or otherwise), please avoid providing any sensitive personal information. Restream does not use your personal information to train Restream’s own AI models. This does not describe the practices of third-party service providers that support certain features (such as Clips) — see “Service Providers and Vendors” above. We may process information submitted to AI-powered features as necessary to provide the requested functionality, respond to your requests, maintain and secure the service, troubleshoot issues, and perform quality assurance and analytics.

Privacy Rights

Certain jurisdictions have specific legal requirements and grant privacy rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. If you are a California resident, see the “California Residents” section below for additional information as to your rights and to how to exercise those rights. If you are a resident of the EEA, Switzerland, or UK, see the “EEA, Switzerland, and UK Residents” section below for additional information as to your rights and to how to exercise those rights. Nevada residents have the right to opt out of the sale of certain pieces of their information to third parties who will license or sell their information to others. However, Restream does not sell personal information as contemplated by Nevada law. If you are a resident of one of the U.S. states listed below, you have one or more of the following rights: (1) to request additional information about our data collection, use, disclosure, and sharing practices in connection with your personal information; (2) to request the specific personal information collected about you; (3) to request the deletion of the personal information we have about you, with exceptions; (4) to request a restriction on certain processing of personal information; (5) to request correction of inaccurate personal information; (6) to opt-out of the processing of personal information for the purpose of “profiling” in furtherance of decisions that produce legal or similarly significant effects; and (7) to opt-out of the “selling” and “sharing”/“targeted advertising” of personal information as such terms are defined under U.S. state privacy laws. Restream does not sell personal information. We use Google and Meta advertising technologies for retargeting, and certain disclosures made through those technologies may be considered “sharing” or “targeted advertising” under applicable U.S. state privacy laws. For a description of the categories of personal information that are shared/used for targeted advertising and for a description of the categories of third parties that such personal information is shared with, see the chart in the “Information Collected Related to California Residents” section below. Restream does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects. You may also have the right to not be discriminated against for exercising your privacy rights. If you are a resident of one of the following U.S. states, you have one or more of these rights: Alabama (effective May 1, 2027), Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Louisiana (effective January 1, 2027), Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oklahoma (effective January 1, 2027), Oregon, Rhode Island, Tennessee, Texas, Utah, Vermont, Virginia (effective January 1, 2028).

If you are located outside that jurisdiction and seek to exercise your rights under the laws of another jurisdiction, please contact us by emailing support@restream.io. You or, depending on your state of residence, your authorized agent may submit a request regarding your personal information by emailing support@restream.io. Restream does not sell personal information. To opt out of sharing personal information for targeted advertising, where applicable, email support@restream.io. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to the information. We may need to request specific information from you to help us confirm your identity. This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. When you make a request, we may require that you provide information and follow procedures so that we can verify your identity (and the applicable jurisdiction). The verification steps we take may differ depending on your jurisdiction and the type of request. Where possible, we will attempt to match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us do so. We will respond to your request within the time period required by applicable law. However, we may not always be able or required to comply with your request, in whole or in part, and we will notify you in that event.

Jurisdiction-Specific Notices

California Residents

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”), California residents have specific rights regarding their personal information. This section describes Californians’ rights and explains how California residents can exercise those rights.

California Job Applicants

When you apply for a job with Restream, information may be collected about you in multiple ways: you may provide it to us in connection with your application; we may make observations in the application process or collect information from public information sources; or you may authorize us to collect information from other sources, such as a former employer or reference. If you use our Site in the job application process, additional information may be automatically collected, as described above.

Rights Specific to California Residents

Under the CCPA, a California resident has the following rights: (1) to request additional information about our data collection, use, disclosure, and sharing practices in connection with your personal information; (2) to request the specific personal information collected about you; (3) to request the deletion of the personal information we have about you; (4) to request a restriction on certain processing of personal information; (5) to request correction of inaccurate information; and (6) to opt out of selling or sharing personal information. You may not be discriminated against for exercising your California privacy rights. You may submit a request to exercise your rights under the CCPA by emailing support@restream.io. Restream does not sell personal information. You can exercise your right to opt out of sharing personal information for targeted advertising, where applicable, by emailing support@restream.io. You may also designate an agent to exercise your privacy rights on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government issued identification. Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like us to in fact delete your personal information before acting on your request. We will aim to respond to your request as soon as reasonably practicable and consistent with any applicable laws. If we require more time, we will inform you of the reason and extension period in writing. In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, listed below, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

California residents are also entitled to contact us to request information about whether we have disclosed personal information to third parties for the third parties’ direct marketing purposes. Under the California “Shine the Light” law, California residents may opt out of our disclosure of personal information to third parties for their direct marketing purposes. You may choose to opt out of the sharing of your personal information with third parties for marketing purposes. To make such a request you should send (a) an email to support@restream.io with the subject heading “California Privacy Rights,” or (b) a letter addressed to Company at the address listed in the “Contact Us” section below. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Please be aware that not all information sharing is covered by the California privacy rights requirements and only information on covered sharing will be included in our response. We reserve our right not to respond to requests submitted to addresses other than the addresses specified in this paragraph.

EEA, Switzerland, and UK Residents

The following information is provided to EEA residents to comply with the European Union’s General Data Protection Regulation (“GDPR”), and corresponding legislation in the UK and Switzerland, provide EEA, UK, and Swiss residents with certain rights in connection with the personal information you have shared with us. If you are resident in the EEA, Switzerland, or the UK, you have the following rights:

  • The right to be informed. You are entitled to be informed of the use of your personal information. This Privacy Policy provides such information to you.
  • The right of access. You have the right to access your personal information (commonly known as a “subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. If we no longer need to process personal information about you in order to provide our services or Site, we will not maintain, acquire, or process additional information in order to identify you for the purpose of responding to your request. In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request. We endeavor to respond to a verifiable consumer request within 30 days of its receipt consistent with applicable law. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded and we could refuse to comply with your request in these circumstances. The GDPR was established to harmonize data privacy laws across the EU, empowering EU citizens’ data privacy in the process, and reshaping how organizations approach data privacy in a secure and transparent manner.

At Restream, we deploy commercially reasonable efforts to assist our customers in understanding what the GDPR means for their businesses and to assist them in establishing a compliant process of their own. We have made great improvements to our Restream platform to ensure that we comply with GDPR requirements.

Example of Restream Acting as a Processor

In some enterprise integrations, a customer may direct Restream to process limited user information on the customer’s behalf in order to provide the Restream service. For example, an enterprise customer may integrate Restream into its website, portal, or application and direct Restream to process account or authentication information necessary to provide access to the service.

In these circumstances, the enterprise customer may act as the controller and Restream may act as a processor with respect to that processing activity, depending on the particular arrangement and applicable law.

User Data. User data means any data, content, code, video, images, or other materials of any type that a user uploads, submits or otherwise transmits to or through the services. The user will retain all right, title, and interest in and to user data in the form provided to Restream.

In practice, you will usually either expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with an opportunity to opt out of the use of your personal information for Restream marketing purposes.

Automated Decision-Making.

We may use your personal information for the purposes of automated decision-making in relation to our live video streaming service. This automated decision-making will involve checking the info provided by you and matching that with the identity information provided by you.
